Who we are, and what these terms cover
drivelamp is made by Steixner Digital LLC, 16192 Coastal Hwy, Lewes, DE 19958, United States (“we”, “us”). These terms cover the drivelamp app for iPhone and CarPlay, the in-app purchases called drivelamp+, and this website.
The app is licensed to you under Apple's Licensed Application End User License Agreement, together with these terms. Where the two differ, these terms apply as far as Apple's agreement allows. By using drivelamp you agree to both.
What drivelamp is, and what it is not
drivelamp plans driving routes that leave out the kinds of road you choose to avoid, such as highways, merges and ramps, roundabouts and lefts without a light. It describes the drive before you go, guides you by voice, and finds places along the route to pull over.
drivelamp is not a medical device, a therapy or a treatment for anxiety, and it is not a driving instructor. Nothing in the app is medical advice. If fear of driving is affecting your life, a doctor or a licensed therapist can help. drivelamp is not an emergency service: in an emergency, call 911.
You are the driver
- You are always responsible for driving safely and legally, for obeying traffic laws, signs and signals, and for adjusting to the weather, the light and the road in front of you.
- Set up your route before you drive. Do not handle your phone while the vehicle is moving. The voice is there so you don't have to look.
- Where the app's guidance conflicts with the road, the road wins. Never make a turn, a stop or a lane change that isn't safe and legal because the app suggested it.
- Only drive when you are fit and licensed to drive.
Routes and map data
- Routes are computed from OpenStreetMap data, which volunteers keep up to date and which can be incomplete, out of date or wrong. A road you avoid may not be mapped as what it is, so a route can include it.
- drivelamp keeps what you switched off off your routes wherever the map offers another way. When there is no other way, the route preview says what the route still contains. Read it before you set off.
- Places to pull over come from the same map data. A place may be closed, private, full or unsafe at the time you reach it. Use your judgment, and only stop where it is safe and allowed.
- drivelamp does not use live traffic. Travel times are estimates and can be longer or shorter.
- Weather and daylight notes are forecasts and can be wrong. Look Around imagery is Apple's and may be out of date.
drivelamp+
- drivelamp+ adds features to the free app. It is offered as an auto-renewing subscription every 3 months or every year, or as a one-time lifetime purchase. The price is shown in the app before you buy.
- Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically at the same price for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the period ends.
- You can manage or cancel a subscription in your iPhone's Settings, under your name, then Subscriptions. Cancelling stops the next renewal; drivelamp+ stays on until the end of the period you paid for.
- Your first drive includes everything in drivelamp+ at no charge. It is not a trial and nothing renews from it.
- Purchases are handled by Apple. Refunds are Apple's decision under Apple's terms; you can ask for one at reportaproblem.apple.com. To use a purchase on another iPhone signed in to the same Apple Account, tap Restore purchases on the drivelamp+ page.
- We may change what drivelamp+ includes or what it costs. A price change for a subscription takes effect only as Apple allows, after Apple tells you about it.
Fair use
drivelamp is for personal navigation. Please don't send automated or bulk requests to our servers, copy or resell our routes or data, try to get around a purchase, interfere with the service, or use it for anything unlawful. We may stop serving anyone who does.
drivelamp depends on our servers and on services from Apple and others. We work to keep it running but can't promise it will always be available, and we may change or stop features.
Warranty and liability
drivelamp is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of routes, places or travel times, and uninterrupted availability, to the fullest extent the law allows.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for anything that happens during a drive, including delays, wrong or missing map data, places that turn out to be closed or unsafe, and traffic incidents. Our total liability for any claim about drivelamp is limited to the amount you paid for drivelamp+ in the 12 months before the claim, or US$50 if that is more.
Some places do not allow these limits. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived, including those of your province or state.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where the law of the place you live says otherwise for consumers. Any dispute that can be brought in Delaware will be brought in the state or federal courts there, unless the law of the place you live gives you the right to bring it where you live.
Changes to these terms
We may update these terms. The new version will be on this page with a new effective date, and an important change will also be pointed out in the app. Using drivelamp after a change means you accept the new terms.
